HC quashes PSA of Ghulam Ahmed Mir

Srinagar, July 25: The Jammu High Court on Friday quashed preventive detention order of Ghulam Ahmed Mir of Hizbul Mujahideen and directed the police for immediate release of the detainee.

The order was passed by Justice Hasnain Massodi in a petition filed by Ghulam Ahmed Mir alias Zia Mir son of Abdul Aziz Mir of Thanamandi District Rajouri, who was detained under Public Safety Act for allegedly working with HM outfit. The petitioner challenged the order of the District Magistrate Rajouri on various grounds including that the order referred an incident alleged to have taken place in 1999, 2000, 2001 and 2004. He said that in the 2004 he was booked under FIR No 129/2004 under Enemy Agent Ordinance.

The court after hearing the counsel from both the sides observed that the detention order passed by the District Magistrate Rajouri was liable to be quashed. The court directed the authority to release the detainee from custody. SOURCES
